Folketinget har vedtaget det forslag til lov om ændring af bl.a. forskelsbehandlingsloven og ligestillingsloven, som Beskæftigelsesministeriet fremsatte i oktober.

Folketinget har vedtaget lovforslaget, som forlænger den midlertidige arbejdsfordelingsordning til den 31. marts 2022. Derudover fortsætter ordningen uændret.
Coronavirus – Trepartsaftale om forlængelse af lønkompensationsordningen
Regeringen og arbejdsmarkedets parter har aftalt, at den genindførte generelle lønkompensationsordning forlænges til den 31. januar 2022, og at hjemsendelseskravet lempes.

Lov om beskyttelse af whistleblowere er trådt i kraft i dag for alle offentlige arbejdsgivere og alle private arbejdsgivere med over 249 medarbejdere ansat.

Vilkårsændringer under protest
Det var i strid med ligebehandlingsloven at ændre timetal og arbejdssted for en medarbejder efter tilbagevenden fra barselsorlov. Det gjaldt også, selvom medarbejderen fortsatte med at arbejde på de nye vilkår.

Datatilsynet har udtalt alvorlig kritik af en virksomhed, som uden tilstrækkelig adgangsstyring havde oplysninger om bl.a. en lang række medarbejdere liggende på et fællesdrev.

Regeringen og arbejdsmarkedets parter har indgået en trepartsaftale om at forlænge den midlertidige arbejdsfordelingsordning og genindføre lønkompensationsordningen.
Coronavirus – lov om ændring af lov om sygedagpenge og barselsloven vedtaget
Folketinget har vedtaget et lovforslag, som genindfører den midlertidige suspendering af arbejdsgiverperioden samt ordningen med barselsdagpenge til forældre med hjemsendte børn som følge af COVID-19 med virkning fra den 23. november 2021.
Ansvarspådragende langsommelighed
Beskæftigelsesministeriet var erstatningsansvarlig for, at funktionærlovens § 2 a om fratrædelsesgodtgørelse først blev ændret 4 år efter EU-Domstolens dom i Ole Andersen-sagen.
Reference register – no objections
According to the assessment of the Data Protection Agency, there were no grounds for the Agency to initiate a case against a municipality based on the establishment of a reference register.
Adjustments to the Gender Equality Act to ease administration in the public sector – bill sent out for consultation
A draft bill that proposes to abolish gender equality statements and to simplify rules on the gender composition on boards of directors has been sent out for consultation. The new rules are expected to enter into force on 1 January 2025.

The Executive Order on Rest Periods and the Executive Order on Systematic Working Environment Work have been amended in light of the new rules on registration of working hours.
Non-competition clause was forfeited
An employer could not obtain an injunction against a former employee performing consultancy work for a competitor. The district court found that the employer had forfeited the opportunity to enforce the non-competition clause, and the high court dismissed the appeal because the restricted period had expired.
Employment or favour for a friend? Judgment by the Supreme Court
The Supreme Court has established that the concept of ”employment” in the Aliens Act must be interpreted very broadly. A bicycle dealer was fined DKK 10,000 because one of his friends who did not have a work permit had helped him carry a few bikes into the bike shop.
Reason for dismissal was off the mark
An employer’s wish to help a dismissed employee by giving an incorrect dismissal reason in the termination letter could not lead to the principle of equal treatment not being breached.
Registration of working hours – changes to the Executive Order on Rest Periods etc. submitted for consultation
Draft amendments to the Executive Order on Rest Periods and the Executive Order on Systematic Working Environment Work have been submitted for consultation. Among other things, it is proposed to align the exemption for the so-called self-organisers.
Extended leave for twin parents – bill adopted
The Parliament has adopted the bill implementing the political agreement on 13 weeks of additional leave with parental benefits for twin parents and adoptive parents.
In, or not in, fertility treatment?
An employee who was planning to undergo fertility treatment but had not yet started the treatment was not covered by the special protection against dismissal in the Equal Treatment Act.
No collective agreement, no shop steward – judgment by the Supreme Court
The Supreme Court recently upheld the Eastern High Court’s ruling establishing that a shop steward’s function ended at the time of a business transfer because the transferee had renounced the collective agreement.
