Registrering af arbejdstid: Hviletidsbekendtgørelsen mv. ændret
Hviletidsbekendtgørelsen og bekendtgørelsen om systematisk arbejdsmiljøarbejde er nu begge blevet ændret i lyset af de nye regler om registrering af arbejdstid.

Arbejdsgiver var erstatningsansvarlig for, at en operatør fik en rygskade, da hun med håndkraft forsøgte at flytte en pallevogn, der med påsatte rammer havde en vægt på 640 kg.
For sen indsigelse
Højesteret har for nylig afsagt en dom, hvormed det blev fastslået, at en kommune var afskåret fra at gøre indsigelse mod en afgørelse fra AES om varigt mén som følge af retsfortabende passivitet.
Ny bekendtgørelse om systematisk arbejdsmiljøarbejde
De nye regler om systematisk arbejdsmiljøarbejde skal styrke samarbejdet om sikkerhed og sundhed på arbejdspladserne ved blandt andet at gøre APV’en til et mere aktivt redskab og tydeliggøre rollerne i AMO.
Krav om registrering af arbejdstid – lovforslag vedtaget
Lovforslaget, som stiller krav om registrering af arbejdstid for den enkelte medarbejder og giver mulighed for at fravige bl.a. 48-timersreglen for visse medarbejdere, er nu vedtaget.

Højesteret har for nylig behandlet to sager, der omhandlede medarbejdere, der var besvimet i forbindelse med udførelsen af deres arbejde. Højesteret nåede i begge sager frem til, at der var tale om arbejdsskader omfattet af arbejdsskadesikringsloven, selv om arbejdet ikke var årsag til, at de to medarbejdere besvimede.

Adjustments to the Gender Equality Act to ease administration in the public sector – bill sent out for consultation
A draft bill that proposes to abolish gender equality statements and to simplify rules on the gender composition on boards of directors has been sent out for consultation. The new rules are expected to enter into force on 1 January 2025.

Non-competition clause was forfeited
An employer could not obtain an injunction against a former employee performing consultancy work for a competitor. The district court found that the employer had forfeited the opportunity to enforce the non-competition clause, and the high court dismissed the appeal because the restricted period had expired.
Employment or favour for a friend? Judgment by the Supreme Court
The Supreme Court has established that the concept of ”employment” in the Aliens Act must be interpreted very broadly. A bicycle dealer was fined DKK 10,000 because one of his friends who did not have a work permit had helped him carry a few bikes into the bike shop.
Reason for dismissal was off the mark
An employer’s wish to help a dismissed employee by giving an incorrect dismissal reason in the termination letter could not lead to the principle of equal treatment not being breached.

Extended leave for twin parents – bill adopted
