According to the Act on Posting of Workers, foreign enterprises posting employees to Denmark must report various types of information to the Register of Foreign Service Providers (RUT).
In connection with the proposal for the Finance Act 2018, the Government and the Danish People’s Party (Dansk Folkeparti) agreed that in the future it should be possible for the Working Environment Authority (WEA) to order a foreign enterprise to immediately register in the RUT if the enterprise has not complied with the obligation to report.
The proposal has now been given effect with the amendment, which was recently enacted. Thus, in the future the WEA can order an enterprise to immediately report to the RUT, and if the order is not complied with the WEA may issue day fines.
Filing a complaint or bringing a case before the courts regarding orders and day fines will not act as stay of execution.
The new rules come into force on 1 July 2018.
